The mediation fee for the CEDR Solve Clinical Negligence Mediation Scheme provides for all arrangements for and the conduct of a mediation that falls under the Scheme. The fees for the mediations conducted under the Scheme are significantly lower than those for commercial cases due to the streamlining of the administrative procedures.
A different fee will apply depending on whether the parties elect to hold an eight-hour mediation or a four-hour mediation:
Eight-hour mediation price
The total fee for the eight-hour mediation is £1,450 + VAT - (£725 per party for a two party mediation.) The fee covers the following:Four-hour mediation price
The total fee for the four-hour mediation is £950 + VAT - (£475 per party for a two party mediation). The fee covers the following:Please note: any four-hour Clinical Negligence mediation which is agreed to overrun on the mediation day will be re-invoiced as if it had been an eight-hour mediation from the outset. There is no provision for extra hours on the eight-hour mediation option.
If there is any doubt as to whether four hours will be sufficient, CEDR Solve advises that the greater flexibility to cope with unforeseen problems offered by an eight-hour mediation is a wise option.
Please note: the above fees do not include any venue expenses. Venue expenses are to be paid by the parties.
Payment
When the mediation is confirmed with CEDR Solve, a letter enclosing the details of the mediation and an invoice will be sent to the parties.Mediation fees are payable no later than one week in advance of the mediation as a pre-condition of the mediation taking place.
CEDR Solve reserve the right to postpone the mediation in the event that the mediation fees are not paid by the date requested in the mediation confirmation letter. If CEDR Solve postpones the mediation and the mediation is not re-scheduled within 14 days, the mediation may be cancelled and the non-paying party will incur 100% cancellation charges for their share of the mediation fee.
Postponement
Occasionally, parties may wish to postpone the mediation. If a new mediation date is agreed with the same mediator within 14 days of notification of postponement, cancellation provisions (see below) will not apply to this postp0nement. Any subsequent postponement will incur standard cancellation provisions. In any case, parties will be liable for any irrecoverable expenses incurred such as venue hire charges.Cancellation
