Mindgames in mediation; psychology in the commercial case

The core of the commercial mediation may superficially be about balancing the commercial and legal elements of an entrenched dispute. However, the mediator who ignores the psycho-personal elements of the mediation process does so at a cost to the process, the possibility of achieving the best possible outcome and often at their own personal cost. As mediator you may be asked to deal with extremely difficult and emotional situations and with traumatised and vulnerable individuals. This course looks at tools for ensuring that mediators allow themselves to do their own psychological “house-keeping” and also some tools for dealing with situations where parties are psychologically challenged in some way.

Trainers

Dr Karl Mackie CBE

A barrister and psychologist by training, as Chief Executive at CEDR he has taken CEDR to one of the world's largest and best known ADR organisations. He is the former Deputy Chairman of the Civil Mediation Council and was recently awarded the CBE (Commander of the Order of the British Empire) for ‘services to mediation'. He is also a fellow of the Chartered Institute of Arbitrators, is on the panel of mediators/arbitrators of the UK's statutory industrial relations service ACAS, on the national panel of arbitrators for the Prison Service, holds a Ph.D and MBA and is on the Singapore International Commercial Mediators' Panel and CPR International Panel of Distinguished Neutrals.

He mediates and facilitates cases and ADR schemes across a rich variety of sectors of dispute with experience of parties from over 30 different countries. Examples of cases mediated include major work in financial services, commercial and supply contracts, IP and IP, acquisitions, public sector, health and education, employment, insurance and reinsurance, regulatory matters, group actions, as well as work with private clients, media, sports and government cases.

Karl has received international acknowledgement as being one of Europe's best and most experienced practitioners and experts in mediation as a pioneer creating the field. Karl has the unique quality among mediators of understanding both the psychological dynamics of conflict and how negotiations work in business.

Karl has trained over 1000 mediators in the UK, Hong Kong, Switzerland and elsewhere, has been Head of the Centre for Legal Studies at the University of Nottingham, has been awarded Honorary Professorships at the Universities of Birmingham and Westminster and has written several books on mediation and legal skills, including the recent International Mediation: The Art of Business Diplomacy (with Eileen Carroll).

Tracey Fox

Tracey is the Training Manager at CEDR and joined the organisation in October 2002. Since becoming a CEDR Accredited mediator in July 2003 she has mediated, assisted and facilitated disputes from a range of sectors including commercial contracts, employment, construction, telecommunications, neighbourhood, tenancy disputes. Tracey is also on the panel of Mediators for Wandsworth Mediation Service.

A Psychologist by training, Tracey worked in various clinical and neurological rehabilitation positions before combing her genuine interest in people with that of organisational behaviour. With a BSc Psychology (Hons) and an MSc in Occupational & Organisational Psychology both obtained at the University of East London Tracey has particular expertise in the areas of change management, organisational development and performance management. She is qualified to deliver and interpret Level A and B psychometric instruments (personality and ability) including the Myers Briggs Type Indicator.

Tracey delivers training courses in effective mediation practice, Mediation in Organisations, Negotiation and Conflict Management to the public and corporate sectors, Universities, government and non-governmental organisations both in the UK and internationally.
