Deploying the power of the mediator


This 1-day programme will take this issue apart in order to develop practical guidance to assist mediators when in the hot seat. The concept of mediator neutrality all too often obscures the operation of the power both of the mediator and the mediation process. The result can impede its appropriate use for the benefit of parties wishing to settle their dispute. Through the exploration of the concepts of neutrality and power within mediation this course will look at how the mediator can use their own power at different stages in the mediation process to assist the parties in settling the dispute.

By the end of the course participants will have:

  • Explored the operation of neutrality in mediation and its effect on the mediators' interventions during the process.
  • Describe the different forms of power possessed by the mediator and its (often unintentional) impact on the process.
  • Practiced using a range on interventions, both direct and indirect, which involve the legitimate use of the mediator's power, in order to assist the parties to resolve the dispute.

Trainer

James South is CEDR's Director of Training. A mediator with 14 years experience, he has a special interest in the use of power in mediation. His Masters in Law dissertation was on this subject and he has applied this knowledge to the resolution of disputes, which involve inherent power imbalances.
