Forum: Devil in the detail - who drafts the settlement?
Everyone loves a happy ending, but how can you ensure what is drafted at the end ties up all the loose ends rather than letting things fall apart?
In this CEDR Exchange Forum we will consider the spectrum of possibilities that exist when it comes to recording a deal, such as:
- In high-value disputes how prepared should lawyers be to draft an agreement and to what degree is it appropriate for the mediator to be involved?
- In disputes where one or both of the parties attend without representation (and in instances where they have no wish to take legal advice) how far can the mediator go in drafting an agreement?
- Are signed heads of terms always a suitable alternative to a fully drafted settlement agreement?
- What is a headache for non-lawyer mediators and what should even the most experienced lawyer mediators avoid?
We will hear from mediators with different practices of their types of experience of making a good deal.
