Shona LLB(Hons); DipLP; NP; FCIArb is a Partner in the Infrastructure Construction and Energy team at CMS having specialised since 1994 in construction dispute resolution. She has dual accreditation by the Law Society of Scotland as a specialist in Construction Law and in Arbitration Law.
She is a Fellow of the Chartered Institute of Arbitrators (FCIArb), a CEDR Accredited Mediator, CEDR ADR Official, a member of the Chartered Institute of Arbitrators (Scottish Branch) Arbitrator Panel and a member of the RICS Adjudicator Panel.
She is regularly involved in the management and resolution of construction and engineering disputes and has experience in all forms of construction dispute resolution. She is familiar and works regularly with both standard form (including JCT, SBCC, NEC, ICE, IChemE) and bespoke contracts and in framework arrangements.
She has worked extensively with PFI/PPP contracts, at all levels of the contractual hierarchy, particularly on water/sewage treatment, schools, hospital, waste and waste to energy projects and in relation to claims concerning bonds and guarantees.
She has been heavily involved in a number of cases recently concerning defects in PFI projects in their operational phase and changes in law affecting these projects as well as in relation to issues arising following their termination.
She also has significant experience in relation to performance and remediation bond claims having advised in a number of cases.
She is also involved in advising professionals including as RIAS Practice Adviser and Engineer's negligence claims and claims under the NEC Professional Services Contract.
Shona extensively writes for and speaks to industry bodies on construction related topics and was a contributor and joint Editor of the textbook MacRoberts on Scottish Construction Contracts.
She is a Director of the Scottish Arbitration Centre and sits on the Editorial Board of Construction Law magazine. She is Co Vice Chair of the IBA International Construction Projects Committee. She is on the Law Society of Scotland Construction Law Committee. She was on the Scottish Building Contract Committee and the JCT BIM Working Group for a number of years.
She is ranked in Chambers & Partners and recognised in Who’s Who Legal Construction and Legal 500.
