CPD Masterclass: The Risky Mediator
Risk exists in any decision-making process, including that of choosing between accepting a settlement agreement or going to court should no agreement be reached. In this Masterclass, speaker Thomas Gaultier will consider risk assessment in a decision-making process and how this related to mediators, lawyers and business professionals.
This session will explore concepts associated with risk analysis in order to help parties in a mediation or a negotiation view their case from a quantitative risk perspective rather than a qualitative approach. These tools will help mediators and negotiators better identify where the risks lie in the case of the parties and benefit from a more concrete reference for comparison when assessing the merits of a settlement. With the guidance of the mediator in exploring quantified risk, the parties will obtain a greater understanding of their strengths and weaknesses and feel more confident in whichever decision they end up making.
Thomas Gaultier is a Mediator and President of the Mediation and Conflict Prevention Commission of the Union Internationale des Avocats. A New York lawyer by training, Thomas is Of Counsel at Abreu Advogados in Lisbon and Lectures on Mediation, Negotiation and Decision Making at Universidade Católica Portuguesa, Porto.
