Commercial Mediator

Short Introduction

Disputes disrupt, often destroy, commercial relationships which may have taken years to build. Court action often means costs and time spiralling out of control, yet most disputes never reach final hearing. Mediation is how business can reclaim control of disputes. Helping parties reach negotiated settlements is not easy and carries great responsibility. The satisfaction from securing parties' trust, working through difficult moments and landing on a deal that works for them is what drives me as a mediator.

Testimonials

"Your approach was exactly what was required. You had a real understanding of the case and the drivers for settlement. Given the personalities involved, it was hard work, but you kept the mediation process moving forward and we got the deal done – thank you."

(Partner, law firm)

"I just wanted to thank you again for the role that you played in getting this settlement over the line. Our client has specifically emailed me to say that you are the best mediator they have worked with!"

(Partner, Law Firm)

"We were very happy with the conduct of the day. In particular [we] liked the fact you were not afraid to probe some of our assumptions and challenge us, albeit of course in a neutral way."

(In House Lawyer, Contractor)

About Work

My apprenticeship for becoming a Mediator includes 25 years (from trainee to a senior partner) specialising in dispute resolution within the global law firm, Eversheds. I advised clients in the construction, engineering and built environment space handling high value, complex and business critical cases in the courts, arbitration and adjudication. Mediation, as a party representative, was a regular feature of my work and in 2000 I became a CEDR-Accredited mediator. Being an effective litigator is about having a keen eye for detail, critical thinking and appreciating that defining 'winning' varies from case to case. In my partner years, I became sector a leader for energy, infrastructure and water. Alongside this, I was relationship partner for several key clients. In these roles, I demonstrated the ability to win the trust and confidence of clients, develop a deep understanding of their business needs and risks and developing delivery strategies. My deep experience of construction, engineering and infrastructure disputes means I now mediate regularly in this space. However, my mediation practice covers a wide range of commercial contract disputes. My style is to be personable and proactive with parties and advisers. I am rigorous in my preparation. I have been described as "uniquely understanding the mediator's role to help parties have the conservations that need to happen". I appreciate the need for showing understanding and empathy with being curious and challenging. Being evaluative, when needed and appropriate, with parties also comes naturally to me.
