Overview
What is Early Neutral Evaluation (ENE)?
ENE is a flexible, non-binding process in which an impartial expert evaluates the facts, legal merits, or procedural aspects of a dispute early in its lifecycle. It can:
✔️ Break deadlock in litigation or negotiation, enabling settlement
✔️ Provide a realistic view of outcomes, including addressing the wishes of the parties
✔️ Inform strategy and reduce time/costs
✔️ Support better decision-making
Over two practical days, you will:
- Understand the structure, purpose, and scope of ENE
- Learn how to conduct evaluations neutrally and credibly
- Explore how ENE relates to mediation, litigation, and arbitration
- Work through real-world scenarios with feedback from experienced trainers
- Earn CEDR Certification in Early Neutral Evaluation

• An overview of different investigative and evaluative processes
• The different roles of an evaluator
• A framework for ENE
• How to prepare
• Running a process with and without hearings
• How to assess/evaluate
• Practice assessing (as a neutral)
• Experience being a participant in ENE
• Draft an evaluation (as part of the certification process)
You will also receive pre-course preparation material and post course assignments.
