Understanding the P2B Regulation

The P2B Regulation on platform-to-business relations entered into force in July 2020. The P2B Regulation sets rules creating a fair, transparent and predictable business environment for businesses and traders who use online intermediation service providers ("Platforms") to reach their customers.

Scope:
Disputes between Business Users Online Intermediation Service Providers

Online intermediation service providers are Platforms that provide an online marketplace where business users sell their goods or services to customers. The P2B Regulation applies to online intermediation service providers (Platforms) including search engines, app stores and market places.

Platform to Business Requirements

The P2B Regulation requires Platforms to offer mediation as a dispute resolution process to resolve issues with their business users.The P2B Regulation requires Platforms to name at least two mediators that the Platform is willing to engage in a dispute. CEDR’s P2B panel includes over 50 mediators based around the EU. 

The Process:

CEDR's P2B Mediation panel are experienced in mediating business-to-business disputes and cover many areas of expertise including intellectual property, data security, confidentiality and contractual disputes.

Complete ADR Notice/Application Form

To start the process please complete the ADR Notice/Application Form, which can be found here, and send it to the other party.

Party B Completes Form

Party B completes the relevant sections of the ADR Notice/Application Form and sends it to Party A, copying in CEDR at applications@cedr.com.

Payment

Both parties are required to make payment on account for the mediation case fee to CEDR within 48 hours of submitting the completed (Party A & Party B) ADR Notice/Application Form.

CEDR Review

Once payment has been received, CEDR will review the application and provide the name of 1 or 2 recommended mediators and confirm the mediation date.

Agree on Mediator

Parties agree on a mediator and inform CEDR of their selection.

Mediation Confirmed

CEDR will confirm the mediation and provide all relevant information to you in advance. 

For Business Users: FAQs

Can I Request a Specific Mediator?

Where possible, if there is a mediator on the CEDR P2B Panel who you would like to use, we will try and accommodate this request. Both parties will need to provide their consent for that mediator to be appointed.

Do I have to Pay to Mediate Under the CEDR P2B Scheme?

For fee information please see Part III of the ADR Notice/Application Form where our fixed fees are set out in detail. You are required to make a payment on account of 50% of the total fee. The mediator will make a recommendation with regard to the fee split between the parties at the end of the mediation (but to commence, both parties need to pay).

How Do I Prepare?

Once your mediation is confirmed, the mediator will ask you for a summary of your case. This document should provide the mediator with a summary of the key facts and issues, as well as a clear statement of what you would like to achieve at the mediation.

It will be provided to both the mediator and the other party and should be drafted with this in mind.
