Arbitration Process

Arbitration is a private process in which an independent third-party is appointed to decide the outcome of a dispute between two or more parties.

The process may be conducted by a sole arbitrator or a panel, according to party requirements. The decision is final and binding.

Arbitration is often used where parties require a confidential process or where an arbitral award may be more easily enforced in a particular jurisdiction than a judgement from another jurisdiction's court.

Commercial Arbitration

CEDR Solve acts as an administrating body and Appointing Authority, under The UNCITRAL Arbitration Rules (Articles 5-8) and can also supply skilled arbitrators.

CEDR can:

  • Supply details of suitable arbitrator(s) for the parties to consider
  • Appoint arbitrators with the joint consent of the parties
  • Appoint arbitrators with unilateral consent from one party

Parties sometimes require assistance from CEDR during the arbitration in the form of:

  • Managing the exchange of documents
  • Setting up hearings and sourcing venues
  • Providing fundholding services
  • Offering administrative and practical support
  • Providing information on appropriate settlement techniques for use in the arbitration including on the use of a ‘Mediation Window'.

Parties may make a unilateral or joint application to CEDR Solve for the appointment of a sole arbitrator or a panel of three arbitrators.

We will appoint a suitably qualified arbitrator from our panel of experts having considered all material provided by the applicant.

Recommendation Service

We will search for suitable candidate arbitrators that meet your requirements and provide three recommendations with details of their expertise and fees.

Low Cost Arbitration - Arbitration 125

Arbitration 125 is a for parties involved in disputes where they require a binding decision to be made by an independent third party and the claim made does not exceed £125,000. In order to participate in the service and have CEDR Solve appoint an arbitrator under these rules the parties must complete an application signed by all parties and accompanied by payment of the relevant registration fees.

There are different price points for Arbitration 125 depending upon how much is in dispute:

  • Where the claim and counterclaim (if any) totals £75,000 or less, a registration fee of £750 plus VAT must be paid by each party (or as agreed otherwise between the parties)
  • For claims / counterclaims totalling between £75,001 and £125,000 a registration fee of £1,500 plus VAT must be paid by each party (or as agreed otherwise between the parties)

Facilitation of Settlement in International Arbitration

CEDR is also at the forefront of developments in the arbitration world, working with leading practitioners, lawyers and clients to formulate new ideas and improve the quality of the arbitration service that clients receive.

The CEDR Rules on the Facilitation of Settlement in International Arbitration sets out a number of measures that can be used to try and most effectively resolve disputes without the need for a full arbitration. These Rules aim to assist international cases by establishing a safe transnational standard in settlement initiatives.

These measures include the provision for a ‘mediation window' during the arbitration and can be implemented by agreement or through inclusion in a contract clause.
