NHS Mediation Service
CEDR acts as one of three dispute resolution bodies appointed by NHS Resolution to provide independent mediation services to the NHS for clinical negligence and personal injury cases.
About the NHS Mediation Service
The National Health Service Mediation Scheme helps patients and the NHS resolve disputes through structured dialogue and understanding.
Disputes in healthcare settings are often deeply personal and emotionally challenging. This service provides space to discuss the real impact on your life, explore what matters most to you, and reach settlements that go beyond financial compensation alone - whether that's answers, apologies, changes to procedures, or other meaningful outcomes.
Following a successful CEDR pilot in 2014/15, the scheme is now established as an effective alternative to lengthy legal processes.
How to use this Service
Parties can book a mediator, request a recommendation for a mediator, or request assistance in setting-up the mediation process by calling one of our experienced advisors on 020 7536 6060 or emailing adr@cedr.com.
Costs
NHS Resolution covers the full cost of mediation if liability is admitted (in full or in part) or if you don't have legal representation. If liability is disputed and you have a lawyer, you'll need to contribute to the mediation costs.

How long does a Mediation take?
Usually between four and eight hours, though some are quicker and others longer. Please factor this into your travel and childcare arrangements.
Can I choose my Mediator?
Yes. You'll be presented with a panel of expert mediators to choose from, and both parties need to agree on the selection. If you'd prefer, an independent provider can recommend the most suitable mediator for your case.

What happens if we don't reach an agreement?
If agreement isn't reached on the day, you can still refer unresolved issues to a judge for decision. However, most cases do settle either during mediation or shortly afterwards, providing closure for everyone involved.
Can mediation only be held after a claim has been started at court?
No. Mediation often takes place before any court claim is filed, which can save considerable time and costs. Your lawyer will advise whether early settlement makes sense for your case, even if not all evidence has been exchanged yet.
How will the Mediator work with me?
The mediator will review all papers in advance, then work with you through a combination of joint meetings (involving both parties) and private sessions (just your side and your advisers).
During private meetings, the mediator only enters your room when invited. Everything you share privately remains confidential unless you explicitly give permission to share it with the other party. The mediator holds private sessions with both sides, giving you time to discuss strategy with your own team before exploring settlement options.

CEDR developed a specialist mediator panel for this service. Mediators are drawn from a range of backgrounds and are all accredited by CEDR and approved by NHS Resolution.
Having been involved in mediating these cases since the beginning of this service, our mediators have collectively mediated hundreds of medical negligence cases. CEDR will allocate mediators according to their suitability for each case
